This bug has cropped up again in the latest CVS (and currentl 4.0 releases) Here is a patch off of CVS HEAD that fixes the issue.

if you have file uploading disabled the compose.inc doesn't include the attachments.js but still tries to validate using the attachementCheck() function upon submit and fails thus the message can never be sent.
